The new Points Based System (PBS) replacement scheme for International Graduates Scheme (IGS) and the previous Science and Engineering Scheme (SEGS) commenced on June 30th.

The Tier 1 Post Study Work visa route replaced the International Graduate Scheme (IGS) and the Science and Engineering Scheme (SEGS) in June this year.

The Tier 1 Post Study Work visa route was initially only offered as a postal service to the UKBA in Sheffield. As a result PSW applications have taken 4 to 12 weeks to be processed resulting in many applicants and prospective employers, anxiously awaiting the outcome of their cases and the return of their passports.

From 1st December 2008 Post Study Work applicants will be able to lodge their application using the Home Office premium fast track same day service.

THE REQUIREMENTS

To apply under the new scheme from outside the UK , applicants will have to meet the following requirements:
•  not fall under the general grounds for refusal;
•  not have previously been granted entry clearance or leave to remain as a Tier 1 (Post Study Work) Migrant;
•  must score a minimum of 75 points under appendix A (see below);
•  must score a minimum of 10 points under appendix B (see below);
•  must score a minimum of 10 points under appendix C (see below).

The visa will be issued for 2 years and the time spent in the UK under the scheme will not count towards indefinite leave to remain.

To apply under the new scheme from inside the UK , applicants will have to meet the following criteria:
•  not fall under the general grounds for refusal;
•  not have been previously granted entry clearance or leave to remain as Tier 1 (Post Study Work) Migrant;
•  have a minimum of 75 points under appendix A;
•  have a minimum of 10 points under appendix B;
•  have a minimum of 10 points under appendix C;
•  have been granted entry clearance or leave to enter or leave to remain as: - as a participant in the Fresh Talent: Working in Scotland Scheme; - as a participant in the International Graduate Scheme or its predecessor Science and Engineering Graduate Scheme; - as a student; - as a student nurse; - as a student re-sitting examination or student writing up thesis.

Leave to remain will be granted for 2 years. Applicants who are already here under the International Graduate Scheme will score 75 points automatically and should be granted another year. However they will have to meet the English language and Maintenance requirements

IMPORTANT POINTS ON MAINTENANCE/FUNDS/FINANCIAL MEANS – APPLYING IN V APPLYING OUTSIDE THE UK:

Whilst applicants applying from inside the UK will have to show £800, those applying outside will have to demonstrate savings of £2800

 

APENDIX A

QUALIFICATION POINTS

The applicant has been awarded:
(a) A UK recognised Bachelor or post graduate degree, OR
(b) A UK postgraduate certificate diploma, OR
(c) A Higher National Diploma from a Scottish institution

(a) the applicant studied for their award at a UK institution that is a UK recognised or listed body or which hold a sponsor license under Tier $ of the PBS, OR

(b) If the applicant is claiming points for having been awarded a HND from a Scottish Institution that they, studied for that diploma at a Scottish publicly funded institution of further or higher education, or a Scottish bona fide private education institution which maintains satisfactory records of attendance

The applicant’s periods of UK study and/or research towards his eligible award were undertaken whilst he had entry clearance, leave to enter or remain in the UK:
(a) as a Student
(b) as a dependant of someone with leave in any category permitting the admittance of dependants

The applicant made the application for entry clearance or leave to remain as a Tier 1 (Post Study Work) Migrant within 12 months of obtaining the relevant qualification

The applicant is applying for leave to remain and has, or was last granted, leave as a Participant in IGS or SEGS or as a Participant in the Fresh Talent Working in Scotland Scheme 75

 

APENDIX B

LEVEL OF ENGLISH LANGUAGE POINTS
A knowledge of English equivalent to level C1 of the Council of Europe's Common European Framework for Language Learning or above 10

 

APENDIX C

LEVEL OF FUNDS POINTS

£800 Required where applying for Leave To Remain ( from within the UK).

£2800 Required where applying for Entry Clearance (from outside UK)
